All Templates are original works copyrighted by their designer and cannot be copied in any way. ACI does not claim or assert any ownership interest in the digital files except the right to issue this non-exclusive license. These Templates are hereby licensed for Limited Commercial or Personal use and no other use. Professional photographers who purchase these products may combine them with images of their plans to create custom cards or promotional materials in the form of a printed, physical product.

You may not claim that the Templates are your own and you may not share, sell, license for use or in any way distribute the Templates for reuse in their original form or as altered in any fashion. Portions or parts of the Templates may not be removed from the original Template. You may not use or sell the Templates as digital products for sale to third parties. Subject to other terms and conditions of this License, you are hereby granted a non-exclusive, non-transferable license in the Templates as herein stated.

The grant of the License as provided herein does not permit the licensee to sell, assign, license in any fashion except as stated herein. You may not claim the Templates as your property, take products, elements or portions from the Template or use them in any form or fashion except as stated herein. You may not use or permit the Templates or elements within the Templates to be placed upon or within your or any other internet site where third parties submit their own images or images of others that will utilize the Templates.

By use of the templates you agree to indemnify, defend and hold ACI harmless against any and all claims, liabilities or demands based or premised upon (1) your use of the Templates or (2) that ACI has violated the intellectual property rights of any third party by reason of your use. You acknowledge and agree that

1. That each Template is presented in and to be used in an “AS IS” condition;
2. that ACI makes no representations or warranties of any kind, either expressed or implied, about the Templates or the use of the Templates;
3. that ACI’s denial of any warranty is without limitation and will apply to the fullest extent permissible under applicable law;
4. that you are responsible for providing all equipment necessary to access the site and the Templates;
5. that it is solely your responsibility for the sharing and the compatibility with your equipment or software and the site and the Templates;
6. that ACI shall not be liable for any damages arising from the use, interruption of use, suspension or termination of the site, whether intentional or unintentional or the availability or removal of the Template from the site;
7. that your use contrary to the terms of this license will result in irreparable injury to ACI and that money damages or financial compensation may not provide adequate relief injury to ACI;
8. that ACI may seek damages at law or at equity or at both law and equity, including requests for injunctive relief against you.

All orders and sales must be made in advance and prior to the use of the Template. As you are responsible for the compatibility of the site and your equipment and software, you have the responsibility to verify that you are able to utilize the site and Templates before purchasing. Because Templates are digital images and delivered as electronic downloads, there are absolutely no refunds for any reason or cause.

ACI may at any time it deems appropriate and in its sole discretion terminate this License, which termination may be with or without cause. Use of the site following termination will be unauthorized use and subject to penalties and sanctions as by law provided.
